By accessing or using BookedUp ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

BookedUp provides an AI-powered answering service for contractors, including but not limited to HVAC, plumbing, electrical, and garage door service providers. The Service includes voice call handling, lead qualification, appointment scheduling, and notification delivery.

3. Account Registration

To use the Service, you must register for an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

4. Subscription and Payment

BookedUp offers subscription plans as described on our pricing page. By subscribing, you agree to pay the applicable fees. Subscriptions automatically renew unless cancelled. You may cancel at any time, and cancellation will take effect at the end of the current billing period.

5. Free Trial

We offer a 7-day free trial for new users. No credit card is required to start the trial. At the end of the trial, you may choose to subscribe or your access will be limited.

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Transmit harmful, threatening, or harassing content
  • Attempt to gain unauthorized access to the Service
  • Interfere with or disrupt the Service
  • Use the Service to make calls that violate TCPA or other regulations

7. Call Recording and Data

Calls handled by BookedUp may be recorded for quality assurance and to provide transcripts. You are responsible for ensuring compliance with applicable call recording laws in your jurisdiction, including obtaining necessary consents.

8. Intellectual Property

The Service, including its design, features, and content, is owned by BookedUp and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

9. Limitation of Liability

To the maximum extent permitted by law, BookedUp shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or meet your specific requirements.

11. Indemnification

You agree to indemnify and hold harmless BookedUp and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Modifications to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.

13. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason. Upon termination, your right to use the Service ceases immediately.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
